THE FOLLOWING SWEEPSTAKES IS VALID ONLY IN THE FIFTY UNITED STATES AND DISTRICT OF COLUMBIA AND IS OPEN ONLY TO QUALIFIED PERSONS (AS DEFINED IN THESE OFFICIAL RULES BELOW). VOID ELSEWHERE AND WHEREVER PROHIBITED. BY PARTICIPATING IN THE SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF THE SPONSOR. Sweepstakes Name: Freeze Dryer Giveaway (the “Sweepstakes”).
Sponsor: Thomas Cottage Enterprises, Inc. d/b/a “Homesteading Family” (the “Sponsor”).
Eligibility: Each individual entering the Sweepstakes (each, an “Entrant”), at time of entry: (a) must be a legal resident of the 50 United States or the District of Columbia; (b) must be 18 years or older; (c) must have a valid U.S. driver’s license or government issued identification; (d) must have access to the internet in order to enter; (e) may not be, or at any time within the six months prior to the start of the Registration Period (as defined below) have been, an employee, officer, director, member, shareholder, or agent of Sponsor or of Sponsor’s affiliates (the “Released Parties”); and (f) may not be an immediate family member or household member of any individual identified in item (e) above. “Immediate family members” include, for purposes of the Sweepstakes, parents (including in-laws), step-parents, grandparents, siblings (including step-siblings), half-siblings, children (including step-children), grandchildren (including step-grandchildren), and each of their respective spouses and/or domestic partners, regardless of where they reside. “Household members” means people who share the same residence at least three months per year.
How to Enter: Sweepstakes begins at 12:01 am (PT) on July 17th, 2024 and ends at 1:00 pm (PT) on September 5th, 2024 (the “Registration Period”). Entrants must fully complete the online registration page found at https://homesteadingfamily.com/freeze-dryer-giveaway/ (the “Entry Form”). Upon completion of the necessary requirements of the Entry Form, Entrant will receive one (1) entry into the Sweepstakes. No purchase necessary to enter. Entrants may enter only using the Entry Form once and may only submit an entry their own behalf. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. Any attempt by any Entrant to obtain more than the stated number of entries allowed by using same, multiple/different email addresses, social media accounts, identities, or any other methods void that Entrant’s entry or entries and that Entrant may be disqualified.
Receipt of entries may not be acknowledged or returned. Delivery of the Prize requires accurate Entrant information on the Entry Form. Released Parties are not responsible for entries which are lost, late, misdirected, illegible, incomplete, invalid, unintelligible, damaged, or for entries submitted in a manner that is not expressly allowed under these Official Rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry, of any required information, or the failure to capture any such information for any reason including programming or technical errors, or effects of hackers or failure of any electronic equipment, computer or cellular transmissions and/or network connections; all of which will be disqualified. All Entry Forms must be fully complete for all required information and must be received by 1:00 pm (PT) on September 5th, 2024. Only Entry Forms that are fully completed are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
In the event of a dispute as to any entry, registration, or submission, the authorized account holder of the email address or social media account used to enter and associated with the entry will be deemed to be the Entrant and must be eligible according to these Official Rules. The “authorized account holder” is the natural person assigned an email address or social media account by an internet access provider, social media platform, online service provider, or other organization responsible for assigning or providing access to an email address or social media account, as applicable. Proof of being the authorized account holder may be required.
Agreement to Rules:Â By participating, Entrants agree to be fully and unconditionally bound by these Official Rules, and each Entrant represents and warrants that they meet the eligibility requirements set forth herein. In addition, Entrants agree to accept the decisions of Sponsor, as final and binding as it relates to the Sweepstakes and these Official Rules. The Sweepstakes is subject to all applicable federal, state, and local laws.
Prize and Valuations: The Winner will receive the following prize (the “Prize”):

Total Approximate Retail Value of All Prize Awarded: Up to $3,000. Actual/appraised value may differ at the time the Prize are awarded. The specifics of the Prize shall be solely determined by the Sponsor. The Prize shown in any marketing material may differ from the exact prize awarded. Any and all expenses related to the Prize, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. No substitution of the Prize or transfer/assignment of the Prize to others or request for the cash equivalent by Winner is permitted.
Drawing: A random drawing will be conducted on or about September 5th, 2024 by Sponsor to select the winner from among all eligible entries received (the “Winner”). Odds of winning depend on the number of eligible entries received.
Winner Notification: The potential Winner will be notified via the contact information provided upon entry within 24 hours following the random winner selection drawing (the “Winner Notification”). The potential Winner must claim the Prize, as directed by Sponsor in the Winner Notification, within 24 hours of delivery of the Winner Notification. Sponsor shall have no liability for a potential Winner’s failure to receive notices due to the potential Winners’ spam, junk email, or other security settings or for the potential Winners’ provision of incorrect or otherwise non-functioning contact information. If the selected Winner cannot be contacted, is ineligible, fails to claim the Prize within 24 hours from the time the Winner Notification was sent, voluntarily elects not to claim the Prize, or otherwise fails to comply with the Official Rules, the Prize may be forfeited and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture for any reason, no compensation will be given.
Acceptance and Coordination of Prize:Â Upon notification and acceptance of the Prize by Winner, additional details regarding the delivery of the Prize listed above will be given to the Winner and additional communications and coordination between Winner and Sponsor may be needed.
The Prize will be delivered directly from Harvest Right or a Harvest Right supplier. Winner will be issued an IRS Form 1099 and must be willing to provide a W-9 to sponsor upon request.
In all instances, Winner shall be solely responsible for all other obligations relating to the delivery of the Prize.
Acceptance of the Prize constitutes permission for Sponsor to use Winner’s name, likeness, and entry solely for purposes of advertising and trade without further compensation, unless prohibited by law.
The receipt by Winner of the Prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Limitation of Liability; Disclaimer of Warranties: By participating, Entrants and Winner agree to release and hold harmless, the Released Parties, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever arising directly or indirectly out of or relating to Entrant’s participation in the Sweepstakes including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel for, or participation in the Sweepstakes, or possession, acceptance and or/or use or misuse of the Prize or participation in any Sweepstakes related activities and for any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery.
AS A CONDITION OF ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT: (I) UNDER NO CIRCUMSTANCE WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR ANY OTHER DAMAGES, OTHER THAN FOR OUT-OF-POCKET EXPENSES, AND ENTRANT FURTHER WAIVES ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; (II) ALL CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES, OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY -- WITHOUT RESORT TO ANY FORM OF CLASS ACTION -- BY BINDING ARBITRATION (BY A SINGLE NEUTRAL ARBITRATOR SELECTED BY SPONSOR IN ITS SOLE AND ABSOLUTE DISCRETION) IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION; AND (III) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT SHALL SUCH CLAIMS, JUDGMENTS OR AWARDS INCLUDE ATTORNEYS’ FEES. THIS SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF DELAWARE.Â
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE; SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Force Majeure Event: In the event Sponsor is prevented from awarding the Prize or continuing with the Sweepstakes as contemplated herein by any event beyond their control, including but not limited to, fire, flood, natural or man-made epidemic or pandemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, riot or civil disturbance, terrorist threat or activity, war, or any federal, state, or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the Winner in a random drawing from all eligible entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of the Prize described in these Official Rules will be awarded.
Additional Conditions:Â Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend, or suspend this Sweepstakes should non-authorized human intervention, fraud, or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such a case, Sponsor will select the Winner from all eligible entries received prior to and/or after (if appropriate) the action is taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or operation of the Sweepstakes or entry website. Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning the Prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten, or harass any other entrants or Sponsor representatives.
The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
This Sweepstakes is in no way endorsed, associated with, sponsored by, or administered by YouTube, Twitter, Facebook, or any other social media platform it is or may be promoted on.
Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, Entrants may mail their request along with a stamped, self-addressed envelope to Homesteading Family, PO Box 1333, Bonners Ferry, Idaho 83805. Entrants should specify which they are requesting and allow reasonable time for a response by mail.
Use of Data: Sponsor will be collecting personal data about Entrants, in accordance with their privacy policy. Please review the Sponsor’s privacy policy at https://homesteadingfamily.com/privacy-policy/. By participating and submitting an entry, Entrants agree that Sponsor and participating parties are authorized to contact them via email, mail, phone, or any other form of media to make Entrants aware of information pertinent to the Sweepstakes, and to distribute information regarding Sponsor’s featured products, special events, or promotional offers. Entrants may opt-out of Sponsor communications at any time, without affecting their entry, by following provided opt-out instructions.
